Terms of Service for Institutional Customers

Please note, these terms of service are for Institutional Customers only. For all direct to consumer services, please refer to the Terms of Sale policy here.

Marco Learning Products and Services. Marco Learning contracts with schools, districts, and other educational organizations (“Customers”) to deliver a wide range of products and services to support learning at scale.

Upon issuance of a Purchase Order or payment of an invoice, Customers agree to Marco Learning’s Terms of Service as outlined below.

Effective Dates.

Grading Support for teachers is available throughout the academic year, from the later of September 1st OR the date of PO/payment and through June 15th

Live workshops and other live events will be recorded. Recordings will be made available to teachers and/or students via their Marco Learning account shortly after the live event and through the academic year, barring any technical difficulties with recording.

User Accounts. Every student, teacher, and/or administrator (“User”) with a course license will get their own login to Marco Learning’s learning management system and web application (“Site”). As a completely web-based solution, there are minimal technical requirements to use Marco Learning. There is no additional software to download and keep up-to-date—each time a User logs into the Marco Learning Site, the secure platform is ready for use. The Site is used to access:

  • Course content and curricular resources
  • Live online events (including professional development, live review sessions, and more)
  • Recordings of live events
  • Grading and feedback services
  • Teacher and administrator dashboards
  • Customer support

Refund, Rollover, and Transfer Policy. Marco Learning does not provide refunds or roll-overs for unused products. For Student Products, any grading and feedback support must be used in the academic year for which it was purchased. License transfer requests (from one course, teacher, or student to another) are at the discretion of Marco Learning and will be reviewed on a case-by-case basis.

Adding Support. Customers can purchase most Marco Learning products at any time during the academic year. Live workshops and other live events may only be available for purchase at select times during the year.

Our Teachers. A talented and experienced team of current and former teachers, readers, and tutors are responsible for creating and vetting all Marco learning content and leading all online workshops, PD sessions, review sessions, and other live events for teachers and students. All Marco Learning teachers sign a non-disclosure agreement to ensure compliance with Marco Learning’s student privacy policy.

Our Graders. Grading and feedback services for Student Products are provided by Marco Learning graders. Graders are undergraduate and graduate students from U.S. colleges and universities. All graders undergo a rigorous screening and application process before being eligible to work with students and teachers. They also sign a non-disclosure agreement of Marco Learning’s student privacy policy.

Student Records. An authorized administrator agrees that the Customer’s notification of FERPA rights is broad enough to notify parents, guardians, and eligible students that entities like Marco Learning can be deemed school officials. Since Marco Learning has legitimate educational interests in the student information it receives, Marco Learning shall be deemed a “school official” in accordance with Customer policy. Marco Learning collects as little data about students as possible and will not use that data to advertise or market to students or their parents. Grading and feedback guarantee. Our commitment is to provide the best possible support for students and teachers. We actively work with Marco Learning graders to ensure their work product is of high quality, but we do not guarantee grading or feedback quality or timeliness. If a teacher is not satisfied with a reader’s work, they can request a revision at no additional cost.

Consent to Marco’s Privacy Policy and Terms of Use. The use of Marco Learning’s Website and Web Applications acts as an explicit acceptance of Marco’s Privacy Policy and Terms of Use. Marco’s Privacy Policy can be found here and a copy of Marco Learning’s Terms of Use can be found here.

Limitation of Liability.  Marco Learning’s total liability to the customer, whether in contract or in tort (including breach of warranty, negligence, and strict liability in tort) will be limited to the amount paid by the Customer to Marco Learning for Marco Learning products and services during the twelve months prior to the incident giving rise to such liability.

Severability. If any term or provision herein is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision or invalidate or render unenforceable such term or provision in any other jurisdiction.

Assignment. Marco Learning may assign any of its rights or delegate any of its obligations to any affiliate or to any person acquiring all or substantially all of Marco’s assets without Customer consent.

Force Majeure. Marco Learning shall not be deemed liable or responsible to the Customer for any failure or delay in fulfilling or performing any term of this Agreement when and to the extent such failure or delay is caused by or results from acts or circumstances beyond the reasonable control of Marco Learning including, without limitation, acts of God, flood, fire, earthquake, hurricane, explosion, governmental actions, war, invasion or hostilities (whether war is declared or not), terrorist threats or acts, riot, or other civil unrest, national emergency, revolution, insurrection, epidemic, lock-outs, strikes or other labor disputes (whether or not relating to Marco Learning’s workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials, or telecommunication breakdown or power outage.
